Terms of Service (TOS)
 
 
The Grieving Center's Mission is to create a thriving, productive environment devoted to assisting those who have lost loved ones in an atmosphere of community and respect.

The information and television programs found on this site are designed to provide insight through shared experience and knowledge of those who are themselves grieving, and those who work in the field of bereavement as experts and counselors.


The Community's Administrators and Moderators have created the following Terms of Service agreement that governs members' participation and practices within The Grieving Center. As a member/user of The Grieving Center, it is your responsibility to know, and adhere to the Terms of Service.

Not Professional Advice:

Information provided via the Services is not intended to substitute for informed professional, medical, psychiatric, psychological, tax, legal, investment, accounting, or other professional advice. If you submit a question or comment on such a topic, we will assume you are interested in soliciting and receiving or giving general information rather than professional advice. You should bear in mind that the applicability of such general information might vary substantially in different states and according to the individual factual circumstances surrounding a particular question or comment. Accordingly, if you desire or require professional advice, please consult a qualified provider who is licensed in your state or country.

Proper Use:

You agree that you will use the Service in compliance with all applicable local, state, national, and international laws, rules and regulations. Furthermore, you agree that you will not submit questions or comments that are unlawful, defamatory, harassing, abusive, fraudulent, obscene, contain viruses, intended to advertise or sell goods or services, or are otherwise objectionable.

You further agree not to submit questions or comments designed to elicit responses that relate to illegal activity or that infringe upon another party's intellectual property rights.

You may not sell, use, reproduce, modify, edit, translate, publish, perform, display, post, transmit and distribute questions, comments or answers for any public or commercial purpose without the written permission of The Grieving Center.

The Grieving Center does not edit, screen, filter, modify, or otherwise monitor the content of questions or comments in advance of initially posting or displaying such content on the Service.

The Grieving Center takes no responsibility for third party content, nor does The Grieving Center have any obligation to monitor such third party content. Nonetheless, The Grieving Center reserves the right not to respond to or use questions or comments that violate the foregoing conditions and to delete or edit questions or comments, in whole or in part, from the Service at any time for any reason.

 Further The Grieving Center reserves the right to refuse Service to anyone at any time without notice for any reason and to remove objectionable or personally identifiable information from any comments or research questions in its use of such questions and/or comments.

The Grieving Center will not be responsible or liable for the exercise or non-exercise of its rights under this Agreement.

Member/User Conduct:

Members and users are expected to conduct themselves in a manner that is constructive and respectful of others at all times. Additionally, we would hope that each member/user would do their best to facilitate a culture of support and positive reinforcement for those have experienced a loss of family or friends

Members/Users will not use this community for:

Any practices that affect the normal operations of the community (Admins will take whatever steps are necessary to restore service).

Transmitting any libelous, defamatory, or any other material that could give rise to any civil or criminal liability under the law.

Personal attacks. This includes but is not limited to, destructive, abusive, defamatory communications in any form, and retaliatory attacks from personal attacks. If you need assistance, please communicate with someone from our The Grieving Center Team.

Destructive commentary/communications made with the intent to disrupt or attack (Trolling). This applies to any communications within this community, whether in the forums, calendar, pm, chat, or IM.

Advertising or linking to any publications and/or web sites that are age restricted due to content, and/or pornographic in nature.
 
Members/Users found practicing these behaviors receive:

Deletion of the post/s.

First event - warning by email and/or IM.

Second event - Forum Suspension for 1 or 7 days or Temporary Community ban for 3 or 7 days.

Third event - Membership revoked, and access to the community permanently blocked. This includes any duplicate accounts for the same person. The Grieving Center considers this information private and confidential However, there may be certain situations that necessitate otherwise.

Conduct - Zero Tolerance

The Grieving Center maintains a Zero Tolerance on certain behaviors within the community.
These include, but are not limited to the following.

Any threats of physical harm, property damage or acts of violence toward another individual, or group of individuals.
 
Soliciting or Trading of any products illegally. This includes, but is not limited to, requests and/or  distribution of computer software, software security overrides, serial numbers and/or admission of use or possession (warez).

Intentional practices that affect the normal operations of the community (Admins will take whatever steps are necessary to restore service).

Any member found to be impersonating a moderator or Admin of The Grieving Center will have his/her membership revoked.

Members/Users found practicing these behaviors will immediately have their membership revoked, and access to the community permanently blocked from the community including any duplicate accounts for the same person. The Grieving Center considers this information private and confidential. However, there may be certain situations that necessitate otherwise. The appropriate legal authorities will be contacted, and if appropriate charges may be filed.

Intellectual Property

Copyright Policy (Please Read)

The Grieving Center remains the original copyright holder in all materials (software, videos and written / image based content) provided on the community. Use of the material inconsistent with the terms and conditions set forth is prohibited and considered an infringement of the copyrights of the respective holders unless specially stated otherwise.

Communications

The Grieving Center provides a variety of communication services to members. These include: forums, gallaries, chat rooms, message boards, and instant messaging. Any information provided by members using these services is considered public information and is logged. The Grieving Center has access to these communications and willreview them if needed. The Grieving Center will not be held responsible and/or liable for information that memberschoose to share via these services. We strongly recommend that members exercise forethought and caution prior to disclosing any personal information while using these services.

Privacy Statement

The Grieving Center maintains a database of member/user information to facilitate the community's operations for members, users and administrators. The following discloses our information collection, use and dissemination practices.

E-mail Addresses: Member e-mail addresses are stored in a database for use in distributing member selected newsletters. This information is not shared except in cooperation with appropriate authorities in the case of violations of our Zero Tolerance Conduct.
 
IP addresses: Member/User IP addresses are collected, and stored in a database to help diagnose, track, and manage issues within the community. This information is not shared except in cooperation with appropriate authorities in the case of violations of our Zero Tolerance Conduct.

Cookies: The Grieving Center Servers are programmed to read, and write member/user specific cookie files. The use of these files is limited to page views and stored information provided by the member. This includes member passwords and aggregate data. Please note that any data other than that contained in The Grieving Center cookie files cannot be read off your hard disk.

Aggregate Data: The Grieving Center collects, and uses aggregate data for the purpose of soliciting advertisers. This data includes page views, ad impressions, click throughs, total membership and total number of subscribers. No personal information is shared with this statistical data.
 
Off-Site Links: The The Grieving Center community contains links to a variety of other web sites. These are usually in the form of product advertisements, and/or member/user provided links. The Grieving Center cannot, and will not
be held responsible for the privacy practices, or content of any web site other than our own.
 
By visiting the The Grieving Center website, you agree that the laws of the State of New York, without regard to principles of conflicts of laws, will govern the Terms of Service and a dispute of any type that may arise between you and The Grieving Center in connection with your use of the website. In addition, you agree that any legal action that may arise between you and The Grieving Center in connection with your use of the website shall be brought exclusively in the New York or the United States District Court for the District of New York, to which you submit to the exclusive jurisdiction and venue thereof.

You further agree that in the event litigation ensues over the Terms of Service and your use of the website, the prevailing party in any such litigation shall be entitled to recover all costs and expenses, including, but not limited to, reasonable attorney's fees, court costs and attendant expenses, from the non-prevailing party.
